Traffic Violations in New York: Moving Violations
Speeding, running red lights, failing to yield, reckless driving, and DWI offenses are violations that occur while the vehicle is moving. The category also includes some offenses that might not be so obvious, such as seat belt violations and failure to properly use a child restraint system. These are also deemed moving violations if those devices should have been used while the driver is operating the vehicle (i.e., a child or non-belted person was in the car).

Traffic Tickets in New York: Non-Moving Violations
In addition to parking tickets, non-moving violations include:
- Not having your driver's license with you in the car.
- Having incorrect information on your license.
- Letting your registration expire.
- Failing to provide proof of insurance.
- Driving a vehicle with faulty equipment or illegal alterations, such as window tinting that is too dark.
Parking tickets and other non-moving violations are handled by the issuing municipality.
If you're ticketed for a moving violation in another state, you normally won't receive points on your New York State driver's license, unless you fall under one of the following exceptions:
- The violation is drug or alcohol-related.
- The violation occurs in Quebec or Ontario, which have special reporting agreements with New York State.
If you ignore an in-state ticket or one received in any state other than Wisconsin, Montana, Oregon, Michigan, California, or Alaska, your New York driver's license can be suspended until the issue is satisfactorily resolved. In addition to paying any fines or surcharges, you will also have to pay a suspension termination fee to the DMV.
It's important to note that if you are convicted of a drug or alcohol-related traffic conviction in any state, the New York DMV will revoke your driver's license for at least six months.
