New York Traffic Violations
Traffic Ticket Defense in New York
New York is no different from other states when it comes to common traffic violations. Drivers in New York are often ticketed for a moving violation (such as speeding), reckless driving, running red lights, and driving while impaired or under the influence. Drivers who insist upon driving without a license or with a suspended or revoked license receive their share of tickets, too. In the summer months, motorists rushing out to the Hamptons from New York City are frequently involved in traffic violations on Long Island's clogged highways. If you have a Nassau County traffic violations, a local New York traffic violation attorney such as Kenneth S. Feraru can represent you.
Traffic Tickets in New York
Many ticket recipients as well as motorists' associations have suggested that today's economic woes have pushed some municipalities to ticket more drivers as a way of generating badly needed revenue. Whether that's true or not, New York State takes traffic violations and their associated penalties very seriously and won't hesitate to take the license of repeat offenders.
New York operates on a motorist point system. The state will suspend your license if you:
- Accumulate 11 or more points in 18 months
- Are convicted of three or more speeding violations in 18 months
- Are convicted of any drug or alcohol-related offense
For certain New York traffic violations occurring on or after November 18, 2004, the state also assesses a Driver Responsibility Fee for the next three years. These violations include:
- Drug or alcohol-related offenses.
- Refusal to take a chemical test.
- Accumulation of six or more points in the 18-month period in New York State, Quebec or Ontario (reciprocal reporting areas).
These fees, penalties, and assessments can add up. The Driver Responsibility Fee for driving while intoxicated is $250 per year or a total of $750, plus any fines and a suspension termination fee. In all likelihood, your vehicle insurance premium will also increase. Because a New York traffic ticket violation can be so costly, many drivers don't feel comfortable fighting the court battle alone.
Kenneth S. Feraru, New York traffic violation lawyer, understands the New York traffic violation law and has successfully represented New York drivers charged with both moving and non-moving violations.
